Experience

Susan litigates and advises clients on a wide range of commercial matters, including professional liability, director and officer liability, contract, and matters involving fraud. She has extensive experience representing receivers and liquidators of insolvent financial institutions and insurance companies, and she represents clients in shareholder and partnership disputes, and in a variety of business torts. Susan has conducted internal investigations and advised clients on a broad range of sensitive business issues. She also represents aviation interests, including foreign airlines, in state and federal court. She is a member of the Northern District of Illinois Trial Bar and has tried more than a dozen cases.

Representative Engagements

  • Lead counsel for receiver of insolvent institution in officer liability case, involving $52 million in damages.  Reached a favorable settlement within a year of retention after targeted discovery of defendants.

  • Lead counsel for receiver of insolvent institution in director and officer liability case involving $13 million in damages. Intervened and removed shareholder derivative suit on behalf of receiver. Achieved favorable settlement of claims, including dismissal of shareholder claim.

  • Lead counsel for receiver of insolvent institution in director and officer liability case, involving $20 million in damages. Intervened and removed shareholder derivative suit on behalf of receiver. Achieved favorable settlement of claims, including dismissal of shareholder claim.

  • Investigated 12 failed institutions ranging in size from $150 million to $3 billion in assets and provided client with recommendation as to whether to bring claims against directors, officers, attorneys, accountant, and other outside professionals.

  • Served as special counsel to Audit Committee of not-for-profit professional organization that led to termination of membership director’s position.

  • Represented receiver of insolvent company in distribution of estate funds, including negotiations with guaranty funds.
