Commercial Litigation

We provide our business and government clients with tailor-made representation targeted to resolve the disputes they face.  We tackle the complex issues, and at the same time, we are mindful of how the dispute fits within our client’s big picture.  Our commercial litigation experience spans a diverse range of industries, including banking, management and technology consulting, manufacturing and distribution, construction, aviation, real estate, and title disputes.


Internal investigations

We have worked with state and federal agencies and with audit and compliance committees of corporate boards to perform internal investigations.  We provide well-supported and timely analyses of whether the conduct at issue raises meritorious claims or subjects our clients to scrutiny.  We understand the sensitive nature of such inquiries, and we work to bring a principled and diverse voice to issues requiring investigation.


Management-Side Employment

We represent employers in a wide range of legal employment issues. We provide proactive guidance in drafting human resources policies, executive employment agreements, and non-compete provisions, helping our clients minimize future legal risks. We assist employers in navigating performance and leave issues and negotiating severance agreements.  We offer independent investigations of purported discrimination, retaliation, and other employment claims, bringing to bear a sensitivity honed from years of experience interviewing claimants and individuals involved in allegations of harassment and discrimination. Our deep knowledge of the administrative agency process allows us to provide our employer clients with realistic case evaluations into the viability of employee administrative charges, so that cost-effective decisions can be made early in a dispute. We represent employers in disputes about the enforceability of noncompetition provisions. And when litigation is brought by former or current employees, we vigorously defend our clients against discrimination and retaliation claims, alleged pay or leave violations, and business torts.


Contract issues

We have analyzed, advised on, and when necessary, litigated contracts of all types, from standard real estate contracts to the most complex of reinsurance agreements, and everything in between.  We understand that resolution of contract issues is part of the day-to-day existence of our clients’ companies, and that efficient analyses and resolution of these issues is critical to their operations.   


Real estate matters

We represent residential and commercial owners and developers in the sale and purchase of residential and commercial properties, including condominium buildings, hotels, restaurants, office buildings, shopping centers, and other properties.  We have also handled various real estate-related litigation matters, including landlord-tenant disputes, title insurance litigation, zoning and ordinance issues, construction litigation, and mortgage fraud. Our decades of experience working in the real estate industry – both in the transaction matters and in litigation – provides us with a unique perspective that benefits our clients.


Aviation defense

For more than a decade, we have represented domestic and foreign airlines, leasing companies, and other aviation interests in both state and federal court.  From baggage and passenger delay claims under the Montreal Convention to major aviation-related disasters, we understand the issues at stake and have assisted airlines in state and federal court.


Bankruptcy

We represent businesses and individuals as both creditors and debtors in reorganizations/debt restructuring.  We also have substantial experience in representing lenders in all facets of bankruptcy litigation, including lien disputes, adversaries, trustee disputes, and claim objections.
